The Legal Landscape of Same-Sex Partnerships in New Jersey
The New Jersey Domestic Partnership Act (DPA), enacted in 2004, positioned New Jersey as the fifth state in the United States to recognize same-sex domestic partnerships. This pioneering act granted same-sex couples the same rights and obligations accorded to married couples, with two notable distinctions:
- Property acquired by one partner during the domestic partnership remains that individual’s property, unlike in a marriage where joint ownership can be presumed.
- The status of a partnership does not grant or diminish individual partners’ rights and responsibilities toward children.
Following the landmark case of Lewis v. Harris, 188 N.J. 415 (2006), the New Jersey Legislature established civil unions by amending the marriage statute to include same-sex couples. This amendment effectively extended all the rights and obligations underscored by the DPA to civil unions. As a result, such partnerships received the same level of benefits and protections as those accorded to married couples. Consequently, the process for dissolving civil unions among same-sex couples now mirrors that of traditional marriage dissolutions.
