4 Types of NJ Alimony Explained
Navigating a divorce is rarely simple, especially when financial stability hangs in the balance. In New Jersey, spousal support, commonly known as alimony, is designed to ensure both parties maintain a lifestyle reasonably comparable to the one established during the marriage.
Under the current New Jersey family law, permanent alimony has been replaced. Instead, courts categorize spousal support into four main types depending on the length of the marriage, economic need, and earning capacity.
1. Open Duration Alimony
Replacing permanent alimony, Open Duration Alimony typically applies to marriages lasting 20 years or longer. While there is no predetermined end date at the time of the final divorce judgment, payments generally terminate upon the paying spouse reaching full retirement age. However, modifications can be requested if either party experiences a significant, permanent change in financial circumstances.
2. Durational Alimony
For marriages lasting less than 20 years, courts usually award Durational Alimony. Under New Jersey law, the length of alimony payments cannot exceed the total duration of the marriage except under exceptional circumstances. For example, if you were married for 10 years, your alimony obligation or award will generally not exceed 10 years.
3. Rehabilitative Alimony
Rehabilitative Alimony is a short-term arrangement meant to support a spouse while they acquire the education, training, or employment skills needed to become self-sufficient. When awarded, the recipient must provide a clear plan detailing the timeline, scope, and goal of the training or educational program.
4. Reimbursement Alimony
Reimbursement Alimony applies to specific circumstances where one spouse supported the other through advanced education or professional training (such as medical or law school) with the expectation of sharing in the financial rewards. If the marriage ends before those rewards are realized, the court may order reimbursement to compensate the supporting spouse for their financial contribution.
